CLIENT AGREEMENT
NATURE OF SERVICES
Mod Health Co. provides functional health consulting, education, wellness services, protocols, and supplement guidance for informational and educational purposes only. These services are not a substitute for medical advice, diagnosis, or treatment from a licensed medical provider. We do not act as primary care providers, and we do not prescribe medication or offer medical procedures.
Our recommendations are rooted in functional and holistic health principles and may include support for gut health, detoxification, lifestyle changes, and personalized education.
SERVICES COVERED BY THIS AGREEMENT
This agreement applies to any and all current or future services, products, memberships, or offerings provided by Mod Health Co., whether purchased now or in the future, including but not limited to:
- Functional lab test ordering and review
- Custom protocols
- Coaching and consulting (live, virtual, or pre-recorded)
- Slack messaging and support
- Nutrition consultations and supplement recommendations
- Access to digital platforms, educational content, and community forums
- Group programs, memberships, and live calls
- Products or services delivered by team members, contractors, or affiliates of Mod Health Co.
LABS, TESTING, AND PROTOCOLS
Lab testing is optional and not diagnostic. All test results are interpreted through a functional lens. Protocols developed by Mod Health Co. are non-medical recommendations designed to support the body’s natural healing ability and are not intended to treat or cure disease. Testing turnaround times vary by lab. You are responsible for submitting your sample in a timely manner.
PAYMENT TERMS
All pricing and payment terms are displayed at checkout. By purchasing any offer, you agree to:
- Pay the full amount due, either in full or through an approved payment plan
- Abide by the payment schedule selected at checkout
- Understand that no refunds will be provided under any circumstances, even if services are not completed or fully utilized
- Understand that your services will not begin until payment is received
- Be responsible for updating payment methods as needed
MEMBERSHIP RENEWAL & CANCELLATION
Mod Membership subscriptions (monthly or annual) will automatically renew unless canceled. You may cancel your membership at any time by emailing [email protected] at least 3 business days prior to your next billing date (monthly members) or 7 days before your annual renewal. Cancellations submitted after this window may result in one final charge. No refunds will be provided once billing is processed.
CANCELLATIONS, MISSED APPOINTMENTS, AND COMMUNICATION
If you book an appointment, it is considered confirmed once scheduled. Missed or canceled appointments will not be refunded, nor will additional time be added to your package or program. It is your responsibility to reschedule.
Support via Slack or email is provided within the scope of your package or add-on. We do not guarantee 24/7 response time. If you are in an emergency, please call 911 or seek immediate medical attention.
SUPPLEMENT DISCLOSURE
We may recommend nutritional supplements through Fullscript or other vendors. These recommendations are not medical advice. You are free to purchase supplements wherever you choose.
DISCLAIMERS
- We do not file or provide insurance paperwork, ICD-10 codes, or superbills.
- Our communications are not HIPAA-secured. You agree to engage via email, Slack, and other platforms with this understanding.
- We do not guarantee results or outcomes from any product or service.
- All services are educational and supportive in nature.
INTELLECTUAL PROPERTY & COMMUNITY GUIDELINES
All resources, calls, protocols, and education provided by Mod Health Co. are the intellectual property of the company. Redistribution is prohibited.
If participating in a community forum or live call, you agree to be respectful, non-disruptive, and protect the confidentiality of others.
CLIENT RESPONSIBILITY
You acknowledge that you are responsible for your own health decisions and agree to consult with a qualified healthcare provider before making any changes to your medical care, medications, or lifestyle based on our services.
CONFIDENTIALITY
You agree not to share any personal, health, or business information disclosed by other clients in any Mod Health Co. program, community, or call. We reserve the right to remove any participant who breaches this policy.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Mod Health Co. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our liability under this agreement shall not exceed the total amount paid by you for the services in question.
LEGAL & FINANCIAL RESPONSIBILITY
You agree to be financially responsible for all payments and fees incurred. If legal action is required to resolve nonpayment, you will be responsible for any associated costs, including attorney’s fees.
GOVERNING LAW AND JURISDICTION
This agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising out of this agreement shall be resolved through binding arbitration or in the appropriate courts located in El Paso County, Colorado.
FINAL ACKNOWLEDGEMENT
By completing your purchase and checking the box marked “I have read and agree to the terms,” you confirm that:
- You are not seeking diagnosis or medical treatment from Mod Health Co.
- You understand your participation is educational and self-guided
- You are of sound mind and voluntarily accept this agreement
- You have the option to review this agreement with legal counsel if desired
